Hi, This agency (supposedly a lawyers office but i found out that it is just a debt agency) keeps calling me at least 5-8 times a day (today alone he has called me 4 times within 1 hour) and threatening to take me to court if i do not pay him 0 for this payday loan from 2007 that I never received( I have NEVER even applied for one!!). He has been calling since march… Along with harassing me he also calls my mom’s house and told her I have to pay or he is gonna sue me, gave her my name, social security number, address, date of birth etc. and also faxed her a paper with all my info on it. Do I have a right to take them to court for harassment and violating my rights? any advice or experience is helpful!!

Then use letters located here to get the debt collector to validate that the debt is yours and then get them to stop calling you: http://www.credittrauma.com/free-letters/collection-accounts/
I’d also get a copy of your credit report through http://www.AnnualCreditReport.com. You can get one once a year for free. Check to see if this item is even reporting on your credit and use the on-line dispute system to dispute it there as well.
Make sure you get all their information in case they continue to harass you. You’ll need it if you decide to pursue this further.
You are correct. Common sense has the best answer and in fact beat me to it. I have seen the adverts for Payday and I have also looked at the small print on their leaflets an had a Guffaw!
